Terms of Use

1. Acceptance of terms

By downloading or using HGV Nav ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app. These terms are governed by the laws of England and Wales.

2. Who may use the app

HGV Nav is intended for use by professional HGV drivers and transport operators in the United Kingdom. You must:

• Hold a valid driving licence for the vehicle category you are operating.
• Be at least 18 years old.
• Comply with all applicable road traffic legislation, including the Road Traffic Act 1988, the Road Vehicles (Construction and Use) Regulations 1986, and driver hours regulations.

3. Nature of the service

In particular:

• Height and weight restrictions — always verify restrictions using physical signs before proceeding. Bridge height data may be incomplete or out of date.
• Speed limits — speed limit data is indicative and sourced from HERE. Always observe posted signs, which take precedence.
• Hazmat routing — HGV Nav's hazmat preference adjusts routing parameters; it is not a substitute for ADR compliance or legal route planning advice.
• STGO / abnormal loads — HGV Nav does not provide statutory route authorisation. STGO movements require proper notification to Highways England and police.
• Driver hours — break reminders are a convenience tool. Compliance with EU tachograph rules and WTD is your legal responsibility.

4. No warranty

HGV Nav is provided "as is" and "as available" without warranty of any kind. We do not warrant that:

• Routes are free from restrictions applicable to your specific vehicle.
• Map data is accurate, complete, or current.
• The app will be available without interruption or error.
• Intelligence layer data (traffic incidents, roadworks, hazards) is accurate or up to date.

5. Limitation of liability

To the maximum extent permitted by law, Michael Hipkiss and HGV Nav shall not be liable for any direct, indirect, incidental, or consequential loss arising from:

• Following a route that results in a traffic offence, vehicle damage, or delay.
• Inaccurate bridge height, weight limit, or restriction data.
• App unavailability during a journey.
• Loss of data stored on your device.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

6. User-submitted content (Yard Intel)

If you submit a Yard Intel report (yard access note, site condition, photo), you grant HGV Nav a non-exclusive, royalty-free licence to display that content to other users of the app. You confirm that:

• The content is accurate to the best of your knowledge.
• You have permission to photograph and share any site shown.
• The content does not include personal data of third parties without their consent.

We reserve the right to remove any content that is inaccurate, inappropriate, or reported by other users.

7. Intellectual property

All software, design, and content in HGV Nav is owned by Michael Hipkiss or its licensors. You may not copy, reverse-engineer, or redistribute any part of the app without prior written permission.

8. Third-party services

HGV Nav integrates third-party APIs (HERE, TomTom, Mapbox, what3words, National Highways, TfL, Supabase). Your use of these services is also subject to their respective terms. We are not responsible for the availability or accuracy of those services.

9. Termination

We may update, suspend, or discontinue the app at any time without notice. You may stop using the app at any time by deleting it from your device.

10. Changes to these terms

We may revise these terms from time to time. The effective date will be updated accordingly. Continued use of the app constitutes acceptance of the revised terms.
